Schappelle Corby has been told by an Indonesian court that her 20 year sentence for allegedly smuggling drugs into Indonesia would be reinstated following an appeal attempt. Her lawyers had previously been successful in reducing her sentence to 15 years.

Indonesian police allege that Corby smuggled 4.1Kg of marajuana hidden in a body board bag into Bali. Corby has maintained that the drugs did not belong to her and must have been placed in her bag between Brisbane, Sydney and Bali.

Australian baggage handlers had been caught using passenger’s luggage to distribute illegal drugs.

Judges rejected her appeal last week, reinstating her original sentence at the same time.

The Indonesian supreme court has ordered that the drugs be destroyed, signalling that it is the end of any possible future appeal attempts.

Another twist has emerged in the Corby story with her 18 year old half brother arrested yesterday on charges of producing and possessing a dangerous drug, deprivation of liberty and assault occasioning bodily harm.

Corby’s lawyer Hotman Paris Hutapea said that the development had “totally ruined his case”. Speaking before discovering Corby’s original sentence had been reinstated said he feared the development involving Corby’s half brother, James Kisina, would ruin his attempts to free Schapelle.

Corby’s Balinese lawyer, Erwin Siregar, disagrees with Mr Paris claiming the arrest could provide evidence to reopen her case if there is any proof or statements that the marijuana she was caught with belonged to her half-brother.

In court today, Kisina claimed that he was seeking to obtain information from known drug dealers in Brisbane which could assist in Corby’s appeal.

Below is the outline of the process as described by a leading conveyancing law firm from the point of view of a buyer.

1. Pre-exchange of contracts

Once instructed to proceed on your behalf your conveyancing solicitor will write to the estate agent and financial advisor (where applicable) to confirm our instructions on your behalf. Then he will write to the other sides conveyancing firm with a list of pre-contract enquiries, to confirm our instructions and request them to send the draft contract papers to us. Pre-contract enquiries are a set of standard questions aimed at obtaining more information about the property in question, such as: what furniture (if any) is being left behind, the boundaries of the property, who owns and is responsible for any hedges or fences. If it is a leasehold property, we obtain details of the managing agents, and discover whether the current owner is up to date with things like service charge bills and ground rent.

The next step for your conveyancing solicitor is to carry out searches regarding the property you propose to purchase. These will almost always include a local authority search and an environmental search. Some of the below searches would have been provided in the home information pack and as such would not be required.

Local authority searches usually take around six to nine working days to complete and will establish the following: proposals for any public works such as a new motorway, waterworks or alterations to road systems; whether any new developments are planned in the vicinity of the property; any problems with water drainage systems; and any planning restrictions that may affect your plans to renovate or alter the property.

There may be other searches required, depending on the location of the property, such as a coal-mining search or a search from a local railway network. We will inform you of any such requirement at the earliest.

Draft Contracts

Upon receiving the draft contract from the sellers conveyancing firm, your conveyancing solicitor will check the documentation and raise any specific queries that arise

The contract is then amended by mutual agreement between your conveyancing solicitor (on your behalf) and the sellers conveyancing firm. The contract is a legal document drawn up by the sellers conveyancing firm that sets out the terms of the sale process. The contract will reflect details of the following:- property being sold; names of both the buyer and seller; the property price and details of anything else that has been negotiated to be included with the sale; the date on which the transaction will take place; and the completion date once all parties have agreed on this.

Once your conveyancing solicitor is satisfied with all the legal documents and replies to enquiries in connection with the property, the contract is approved and sent to both parties for signature

2. Exchange of contracts

Deposit

On exchange of contracts of a purchase it is usual to pay to the sellers’ conveyancing firm a deposit of up to 10% of the purchase price, but it is sometimes possible to agree to a 5% deposit.

Once we have your deposit in cleared funds, signed contract and authorisation, your conveyancing solicitor can proceed to the exchange of contracts with the sellers conveyancing firm and agree a completion date. The deposit will be forwarded to the sellers solicitors on exchange of contracts, as security in case you do not proceed with the purchase. (Please read the section below on Money Matters)

Exchanging contracts

Until the exchange of contracts, there is no legal liability on either the purchaser or seller to proceed and either party may withdraw from the transaction at any time.

Once contracts have been exchanged (usually by a telephone call between conveyancing solicitors) both parties become legally bound by the terms and conditions of the contract and will be required to complete the contract.

The agreed completion date will be included in the contract; you will not be able to change the completion date once contracts have been exchanged. If you cannot complete on the contractual completion date your deposit may be forfeited and you may be sued for breach of contract.

Stamp Duty Land Tax (SDLT)

The completion of the SDLT form is your responsibility and you may complete this form on your own or ask your conveyancing solicitor to complete it on your behalf. However, when a conveyancing firm act as your agent in completing the SDLT form they may make a reasonable charge for the additional work. In which case their charges would be reflected in the estimate of costs provided.

Please note that there are strict time limits that must be followed. In the event the SDLT form is not received by the Inland Revenue within 30 days of the date of completion, you will be charged penalties.

3. Pre-completion

Between exchange and completion the following takes place:-

Transfer

The seller will sign the transfer document. This is the document that your conveyancing solicitor lodge with the Land Registry to prove the existing owner agrees to the transfer of ownership of the property to you.

Mortgage funds

If there is a mortgage lender involved, your conveyancing solicitor will contact them to release your mortgage funds in time for completion. Please note, to avoid late completion most conveyancing firms request for mortgage funds two days prior to completion. This may mean that you will be charged interest by the bank for 2 additional days.

Final searches and enquiries

By this stage, Land Registry searches would have been completed. These searches disclose any mortgages that are on the property and any disputes concerning the property.

Financial Statement

Your conveyancing solicitor will send you a financial statement showing the amount required to complete the transaction. This statement will detail all expenses incurred on your behalf or about to incur and includes our fees. It also states the stamp duty payable.

Building Insurance

From the point that contracts have been exchanged, you may become responsible for the property, which means you should obtain suitable building insurance to cover the property. Buildings insurance should be for the full reinstatement value (as specified in your valuation report) and your lenders interest should be noted on it.

4. Completion

On the day of completion, your conveyancing solicitor will send to the sellers conveyancing firm via telegraphic transfer the purchase monies. The sellers conveyancing firm will then confirm receipt once they have received the money, and will then authorise the seller to release the keys to you.

Unless you state otherwise all correspondence from the day of completion will be sent to your new address.

After completion the following happens :

The seller’s conveyancing firm will forward the transfer and title deeds to your conveyancing solicitor.

Your conveyancing solicitor make an application to the Inland Revenue to pay the stamp duty on the property.

Your conveyancing solicitor make an application to the Land Registry to register the property in your name.

Exception to the rules: simultaneous exchange & completion

If the property is vacant and all parties are in agreement with this method of completion, your conveyancing solicitor can arrange for contracts to be exchanged and the transaction to be completed on the same day.

5. Registration

Once the property has been registered in your name, we will send the title deeds to your mortgage lender, who will hold on to these as security until the mortgage has been paid off. You will receive a letter confirming registration of the property in your name with a certified copy of the registration documents showing your ownership of the property.

The army of southern Sudan says more than 100 people were killed when a local tribe attacked a rival group in the southern state of Jonglei.

Gunmen from the Lou Nuer tribe attacked a village of the Dinka Hol tribe on Sunday, driving away security forces who were guarding the remote settlement of Duk Padiet. Southern Sudan army spokesman Kuol Diem Kuol said Monday that the dead include 23 attackers, 28 security forces, and more than 50 villagers, with 46 more injured.

“From the attackers 23 bodies were found on the ground. These attackers were found in uniform with arms and organized in a military organisation in platoons with G3 rifles,” Kuol said.

Jonglei state has experienced multiple deadly clashes involving the Lou Nuer, the Dinka Hol, and other tribes this year.

The area has long been the scene of violent cattle raids between the groups. Southern Sudanese officials say northern Sudan’s ruling party is organizing the attacks to spark conflict and undermine the 2005 peace deal that ended Sudan’s civil war, which calls for the semi-autonomous south to vote on full independence in 2011.

The National Congress Party has repeatedly denied the accusations.

New South Wales Premier, Morris Iemma quit politics on Friday after a disagreement with the governing Australian Labor Party’s dominant “Centre Unity” faction about his proposed cabinet reshuffle. The reshuffle was prompted by the resignation of Deputy Premier John Watkins and the sackings of Treasurer Michael Costa and Health Minister Reba Meagher.

The political fallout follows the botched attempt to privatise the state’s electricity industry.

The right of the Labor party was presented with a list of colleagues who the Premier wanted in and out of his reshuffled cabinet. MPs were frustrated that Joe Tripodi was not on the our list. MPs rejected Iemma’s list and demanded the chance to vote upon it. Mr Iemma then told the faction that unless they accepted his cabinet he would resign. Caucus called Iemma’s bluff and said Iemma had lost support of the party.

The party then looked to the left-wing faction of the party and Nathan Rees was appointed unanimously and unopposed, Carmel Tebbutt was appointed as the state’s deputy premier.

It is the first time in 117 years that a Premier has lost support of his own party and the first time in NSW Labor history that the party has been led by a member from the left.

Speaking to the media, Mr Iemma said he could not lead a cabinet that was not of his own choosing.

“I took what I believed to be a package of renewal, reform and refreshment, for the party, the Cabinet. That was not accepted, so I tendered my resignation.

“I wasn’t going to serve as the head of a Cabinet that was being foisted on me and I wanted change and that was not going to be possible, so I tendered my resignation.”

Following his appointment, Nathan Rees told reporters that he had been elected as Premier of NSW. “Morris Iemma resigned as premier today, I nominated for the vacancy and I was elected unanimously by the full Labor caucus,” Rees said.

“We start work today for the people of New South Wales, we start work this afternoon to deliver services to the people of New South Wales”.

Rees and Tebbutt were sworn in by Governor Marie Bashir on Friday afternoon.

An advertisement for Dove beauty products has been viewed by well over three million people, without ever being on television. A copywriter from Ogilvy Toronto, the advertising agency that created a spot named “evolution”, uploaded the advertisement to video sharing website YouTube.

While the official upload of the ad itself has been viewed 1,119,262 times, there are dozens of copies of the ad on YouTube, adding to a minimum of 3,059,546 views. The official copy of the video is the website’s 12th most viewed this month, 53rd of all time.

Unofficial uploads have each received high levels of viewership, with 449595, 445322, 207906, 201670, 195265, 116501, and 102634 plays.

The agency did not originally intend to upload the video to YouTube, only display it on the company’s homepage. Staff member Tim Piper uploaded it to his account on October 6, about a week before it first got media coverage on Good Morning America.

The ad begins with a woman walking into a photo shoot. From there, she is primped and plucked by hair and makeup artists, then tweaked on a Photoshop-like program. The photo-manipulation is then posted on a billboard for the fictional “Easel Foundation Makeup” brand. Two young, teenage girls walk past, glancing at the board. “No wonder our perception of beauty is distorted” ends the ad in text, “Every girl deserves to feel beautiful just the way she is.”

The creative team for the ad included Tim Piper, Mike Kirkland, Janet Kestin, Nancy Vonk, directors T Piper (treatment and post production) and Yael Staav (live action) from Reginald Pike, Soho post production, Rogue editing, Vapor music, Gabor Jurina and Make-up: Diana Carreiro, and Reginald Pike.

The official French copy of the ad has only received 132 views, although it was only uploaded on November 2, 2006.

The world’s least expensive car, the Tata Nano, has been launched in India. It will go on sale in April, and will start delivery in July. The automobile costs only 100,000 Indian rupees, or just under US$2,000.

“We are at the gates offering a new form of transportation to the people of India, and later I hope other markets as well,” said the chairman of the auto firm, Ratan Tata, calling the vehicle a “milestone.”

“From the drawing board to its commercial launch, the car has overcome several challenges,” Tata said. “I hope it will provide safe, affordable four-wheel transportation to families who till now have not been able to own a car.

“This was never conceived as the cheapest car, but as providing transport to those people who never owned a car,” Tata said. “Driven mainly by the change in demand that we see elsewhere in the world, we suddenly felt we had a product that could be of considerable interest as a low-cost product in western Europe, eastern Europe, the UK and even the U.S.”

The Tata Nano is a four-door vehicle, and is 3 metres long, 1.5 m wide, and 1.5 m tall. It is equipped with a 33 bhp, 624 cc engine at the rear. No radio, airbags, power steering, or air conditioning are available in the basic model, although upgrades are available. The Nano Europa, a slightly larger European version of the car, is expected in 2011.

According to Ravi Kant, the managing director at Tata Motors, the first 100,000 people to receive a Nano would be chosen from the initial orders by a ballot.

An auto analyst for Bombay’s Angel Broking, Vaishali Jajoo, predicted that the Nano will add only three percent to Tata’s revenues even if it can sell a quarter of a million such cars per annum.

“That doesn’t make a significant difference to the top line,” Jajoo said. “And for the bottom line, it will take five to six years to break even.”

Environmentalists say that the car will exacerbate traffic problems already rife in India, and help increase pollution levels. Tata, however, stated that its vehicle is the least polluting car in the country.
